PRIVACY POLICY

This Privacy Policy ("Policy") explains the Subscriber and the Company’s rights and obligations in handling personal information. By using the Service and/or using the Website, you agree to be bound by the Policy which may be updated from time to time. You recognize that this Policy was created for our mutual protection as well as the protection of third parties and our affiliates.

  1. Specified Purpose of Use

    When we collect personal information such as name, residential address, telephone number, email address, we will specify the purpose of use and only collect information that is necessary to achieve such purpose. Additionally, if we change the purpose of use, we will do so only within a scope that is reasonably deemed to be closely related to the original purpose of use.

  2. Notification of Purpose of Use for Collection

    We will provide notice of, or make public, the purpose for which such personal information will be used. We will do the same when collecting written information. When we make changes to the purpose of use in accordance with the preceding Paragraph 1, we will also notify our subscribers of such changes or make a public announcement thereof.

    The personal information we collect from you is necessary to provide you with the best customer experience when using our Website or Service. This personal information may be shared with our parent company, subsidiaries, affiliates, agents, partners, and other third parties, in order to undertake activities that may include, among others:

    1. Conducting analysis for purposes of research and marketing initiatives, including the generation of anonymized or non-personally identifiable location and mobility data to show footfall, location patterns, crowd density, and other information that may be relevant for marketing purposes;

    6. Sharing your personal information with third-party content providers or other third-party services for which you sign up; and

    Any personal information supplied by you will be retained by the Company or any subsidiary, affiliate and subcontractor of the Company and will be accessible to such (as applicable) for the purposes set out in this Policy or as otherwise indicated by prior notice to you. You may opt-out from receiving marketing material and/or communications from the relevant business partners and third-party service providers of the Company.     At times it may be necessary and/or prudent for us to transfer certain personal information to places outside of Japan to carry out the purposes, or directly related purposes, for which the personal information were collected. Where such a transfer is performed, it will be done in compliance with the applicable data privacy laws. We may also transfer your personal information if the Company is acquired by or merged with another company but will notify you first before information is transferred and becomes subject to a different privacy policy.

  4. Collection of Personal Information by Proper Means

    We will collect personal information only by lawful and fair means.

  5. Restrictions on Purpose of Use

    We will handle the personal information we collect only within the scope necessary to achieve the specified purpose of use.     In order to provide appropriate data security control over the personal data, we will provide necessary and appropriate supervision to our employees who handle personal data.

  9. Outsourcing Supervision

    We may outsource the handling or processing of collected personal data to third parties such as but not limited to our agents, vendors and service providers (including IT, network, customer service, and logistics companies), partners, and telecommunications operators to achieve the purpose of use. In such cases, we will select providers that are considered by us as capable of handling personal information in a lawful and proper manner. They may access such information only under set conditions and for such time necessary for the contracted purpose and will be supervised under contract to ensure strict compliance with this Policy.

  10. Sharing Personal Information with Third Parties

    We will obtain prior consent when we share personal information with a third party. However, we may share information with third parties without prior consent when required by law, or if it becomes necessary for the protection of the life, body or property of an individual and it is difficult to obtain prior consent. However, a party shall not be construed as a "third party" if the party receives personal information in the following cases:

    • When all or a portion of the handling of personal data is outsourced to such party within the scope necessary to achieve the purpose of use.
    • When personal data is transferred to such party in conjunction with the succession of our business through a merger, company split or similar transactions.
    • When personal data is to be used jointly with a third party, and information is made available to the customer regarding the items of personal data to be shared, the parties with whom the data will be shared, the purpose for which the data will be used and the contact information of the individual responsible for managing such data.

  12. Publication of Purpose of Use of Personal Data Received In Connection with Outsourced Services

    We will use any personal data obtained in connection with services outsourced to us by third parties solely for the purpose of providing such services.

  13. Disclosure of Personal Data

    When a Subscriber requests that we disclose his or her own personal data to him or her in accordance with Paragraph 16 below, we will exert diligent efforts to respond promptly. However, we may not disclose all or a portion of such data and will charge a fee if we accept a Subscriber’s request for disclosure in the following situations:

    • When there is a risk of personal injury or property damage to the customer or another person or where other rights would be placed at risk.
    • When there is a risk of significant obstruction to the proper operation of our business.
    • When such disclosure would violate the law.
  14. Correction of Personal Data

    When we receive a request from a Subscriber for correction, addition or deletion of his or her own collected personal data in accordance with Paragraph 16 below, we will investigate the request promptly and take appropriate steps based on the results of our investigation.

  15. Discontinuing Use of Personal Data

    When we receive a request from a Subscriber to discontinue use of his or her personal data in accordance with Paragraph 16 below, we will investigate the request promptly and will take appropriate steps based on the results of our investigation.

    We have an administrator responsible for managing personal information and implementing necessary protective measures. We also make efforts to maintain and improve the protection of personal information by periodically conducting in-house audits.

    We educate our directors and employees on the importance of appropriate handling of personal information while ensuring that all necessary measures are implemented.

  19. Legal Compliance

    This Policy shall be construed in accordance with the laws of Japan. We comply with the Law Concerning Protection of Personal Information and the Ministry of Internal Affairs and Communications' Guidelines Concerning Protection of Personal Information in the Telecommunications Industries. We also implement in-house rules appropriate to protect personal information and help ensure compliance with those rules. We will continue to make reasonable efforts to improve our personal information protection management system to keep pace with changes in the surrounding social environment.
